According to POLITICO, the U.S. House of Representatives will vote this week on a bill mandating that the FAA use a formal rulemaking process to address sleep apnea testing and treatment for pilots and air traffic controllers, according to a source familiar with the floor schedule.

The short two-page bill might be moot, however, since several months ago the FAA's federal air surgeon told the Aircraft and Owners and Pilots Association that the agency "will not move ahead" with its proposal.

The measure, which cleared the House Transportation Committee in December, is the second bill this Congress addressing federal agencies' responses to sleep apnea. A separate bill ensuring the FMCSA uses a formal rulemaking was signed into law last October, even though the agency had already announced it would use the regulatory process if addressing the issue.
